Terms & Conditions

Please read these terms carefully before using OntarioDriver.ca. By creating an account or posting a listing, you agree to be bound by these terms.

Platform Overview

OntarioDriver.ca (the "Platform") is operated by Ontario Driver ("we", "us", "our"). The Platform is an online classified advertising marketplace that connects private vehicle sellers and OMVIC-registered dealerships ("Sellers") with prospective vehicle buyers ("Buyers") in Ontario, Canada.

Important — What Ontario Driver is not: Ontario Driver is strictly a classified advertising and lead-connection platform. We do not act as a motor vehicle dealer, broker, agent, auctioneer, or financier. We do not take possession of vehicles, hold funds, facilitate payments, guarantee the quality or title of any vehicle, or take responsibility for the outcome of any transaction between Buyers and Sellers. All vehicle transactions are conducted exclusively between the Buyer and the Seller.

By accessing or using the Platform, you agree to these Terms & Conditions in full. If you do not agree, you must not use the Platform.

Eligibility & Registration

Age requirement

You must be at least 18 years of age to create an account, post listings, or otherwise use the Platform in a transactional capacity.

Account accuracy

You agree to provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

One account per user

Each individual or business may maintain one active account. Duplicate or fraudulent accounts may be removed without notice.

Dealer registration

Businesses operating as motor vehicle dealers in Ontario must hold a valid OMVIC registration number at the time of registration and at all times while listings are live on the Platform. Providing a false or expired OMVIC number is grounds for immediate account termination.

Onboarding gate: All Sellers (private and dealer) must review and accept these Terms & Conditions and the Commission Contract before any listing is published on the Platform.

Listing Rules

Accuracy

All listing information — including year, make, model, trim, mileage, condition, price, photos, and vehicle history — must be accurate and not misleading. Sellers are solely responsible for the accuracy of their listings.

Prohibited listings

The following are strictly prohibited on the Platform:

  • Vehicles with outstanding liens that are not disclosed to prospective Buyers
  • Stolen vehicles or vehicles with altered or removed VINs
  • Vehicles that are write-offs, salvage, or rebuilt without clear disclosure
  • Odometer rollback or misrepresentation of mileage
  • Listings for vehicles the Seller does not legally own or have authority to sell
  • Commercial or fleet vehicles listed under a private-seller account
  • Any listing that violates applicable Ontario or Canadian law

Photos and media

All photos and videos uploaded must be of the actual vehicle being listed. Stock photos or images of similar vehicles are not permitted. You must own or have rights to any media you upload.

Pricing

The listed price must be the actual asking price in Canadian dollars. Bait-and-switch pricing is prohibited and may result in immediate listing removal and account suspension.

CARFAX reports

Uploading a CARFAX Canada report is strongly encouraged but not mandatory. Sellers who upload a CARFAX report acknowledge they have the right to share the document and that the report accurately reflects the vehicle's history. Deliberately uploading a falsified or altered report is grounds for immediate account termination and may be reported to relevant authorities.

Ontario Driver reserves the right to remove any listing that violates these rules at any time, without notice or liability.

Buyer Responsibilities

Buyers use the Platform to discover vehicles and connect with Sellers. By using the Platform as a Buyer, you acknowledge and agree that:

  • All information displayed on listings is provided by the Seller, not Ontario Driver. You should independently verify any information before making a purchase decision.
  • Ontario Driver does not guarantee the accuracy, completeness, or fitness of any vehicle listing.
  • You are responsible for conducting your own due diligence, including arranging independent vehicle inspections, verifying title, and confirming any lien status through official channels (e.g., PPSA search).
  • The Ontario Driver Buying Score™ and AI Deal Finder badges are informational tools only. They do not constitute a warranty, appraisal, or guarantee of value.
  • All negotiations and transactions occur directly between Buyer and Seller. Ontario Driver is not a party to any sale agreement.

Dealer & Seller Terms

Compliance with OMVIC

Dealers must comply with all requirements of the Motor Vehicle Dealers Act, 2002 and OMVIC regulations at all times. This includes advertising standards, disclosure requirements, and the prohibition on misrepresentation.

OMVIC Verified Badge

Dealers who provide a valid OMVIC registration number during onboarding are eligible to display an "OMVIC Verified" badge on their listings and dealer profile. Ontario Driver may verify this number against the public OMVIC dealer registry at any time. A badge does not constitute an endorsement by Ontario Driver or OMVIC of the dealer's business practices.

Seller representations

By posting a listing, Sellers represent and warrant that: (a) they have legal authority to sell the vehicle; (b) all listing information is accurate; (c) the vehicle is free of undisclosed encumbrances; and (d) the sale will comply with all applicable Ontario laws.

Private sellers

Private Sellers who list more than 3 vehicles in any 12-month period may be required to provide documentation confirming they are not operating as an unregistered dealer under the Motor Vehicle Dealers Act, 2002.

Commission & Revenue Model

Results-based only. Ontario Driver does not charge listing fees or subscription fees. Commission is payable only upon a completed vehicle purchase resulting from a qualified lead generated through the Platform.

Definition of a qualified lead

A "qualified lead" means a prospective Buyer who: (a) initiated contact with the Seller through the Platform (via the platform inbox, AI Receptionist, or lead capture form); (b) expressed genuine purchase intent (confirmed by mutual communication records); and (c) was not previously known to the Seller prior to the Platform introduction.

Definition of a completed purchase

A "completed purchase" means a vehicle transaction in which ownership is transferred from the Seller to the Buyer as a direct result of a qualified lead generated through the Platform, as evidenced by a bill of sale, transfer of title, or equivalent documentation.

Verification process

Ontario Driver uses a voluntary milestone tracking system to facilitate verification. Sellers and Buyers are encouraged to update their transaction status (e.g., "Contacted", "Test Drive Scheduled", "Purchase Completed") on the Platform. Where voluntary confirmation is not provided, Ontario Driver may request a copy of the bill of sale or equivalent documentation. Commission becomes payable upon verified completion.

Payment

Commission invoices are issued within 5 business days of verified completion. Payment is due within 15 business days of invoice. Ontario Driver reserves the right to suspend active listings for accounts with overdue invoices.

Disputes

Commission disputes must be raised in writing within 30 days of invoice. See Section 13 for the dispute resolution process.

AI Features

Ontario Driver offers several AI-powered features designed to help Buyers and Sellers make more informed decisions. These include:

  • Ontario Driver Buying Score™: An AI-generated transparency score based on vehicle details and CARFAX data provided by the Seller. The score is informational only and does not constitute a professional appraisal, warranty, or guarantee of any kind.
  • AI Deal Finder Badges: Visual indicators generated by AI reasoning. These badges reflect AI analysis only and are not endorsements or valuations.
  • AI Affordability Calculator: Estimates based on user-provided inputs and Ontario averages. Results are illustrative only and do not constitute financial advice.
  • AI Receptionist: A conversational AI assistant that helps qualify Buyer interest and answer general questions. It is not a human representative and may make errors.
AI limitations: AI features are provided as helpful tools only. Ontario Driver makes no representations regarding the accuracy, completeness, or fitness of any AI-generated output. You should not rely solely on AI features when making purchase, sale, or financing decisions. Always conduct independent due diligence.

OMVIC & Regulatory Compliance

Ontario Driver is committed to supporting a transparent and compliant automotive marketplace in Ontario.

OMVIC Disclosure: Ontario Driver is not a registered motor vehicle dealer under the Motor Vehicle Dealers Act, 2002 and is not registered with OMVIC. We operate strictly as a classified advertising platform. Buyers dealing with OMVIC-registered dealers benefit from the protections of the Motor Vehicle Dealers Act and OMVIC's consumer complaint process. Buyers dealing with private sellers do not have access to these protections.

Dealers are solely responsible for ensuring their listings, advertising, disclosures, and sales practices comply with OMVIC requirements. Ontario Driver does not review listings for OMVIC compliance and is not responsible for dealer non-compliance.

Messaging & Communication

The Platform provides an integrated messaging inbox for communication between Buyers and Sellers. By using the messaging system, you agree to the following:

  • All communication through the Platform must be lawful, respectful, and directly related to vehicle transactions.
  • Spam, harassment, unsolicited advertising, and fraudulent messages are strictly prohibited and may result in account termination.
  • Ontario Driver may review messages for platform safety and moderation purposes, consistent with our Privacy Policy.
  • Automated follow-up reminders from the AI Receptionist are sent only with your explicit consent and may be opted out of at any time.
  • Ontario Driver does not monitor or take responsibility for off-platform communications between Buyers and Sellers.

Intellectual Property

Platform content

All content on the Platform created by Ontario Driver — including the Ontario Driver Buying Score™ methodology, AI features, branding, design, and written content — is the intellectual property of Ontario Driver and may not be copied, reproduced, or distributed without prior written consent.

User content

By posting a listing, you grant Ontario Driver a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute your listing content (including photos and vehicle descriptions) on the Platform and in related marketing materials for the duration your listing is active. You retain ownership of all content you upload.

No scraping

Automated scraping, harvesting, or bulk downloading of any content from the Platform is strictly prohibited without prior written authorization from Ontario Driver.

Liability & Disclaimers

Platform provided "as is"

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Ontario Driver does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of liability

To the maximum extent permitted by applicable Ontario law, Ontario Driver shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to: losses arising from vehicle transactions, reliance on AI-generated content, loss of data, or unauthorized access to your account.

Third-party transactions

Ontario Driver is not responsible for any dispute, loss, damage, or legal claim arising from a transaction between a Buyer and a Seller. All such transactions are conducted entirely at the parties' own risk.

Indemnification

You agree to indemnify and hold harmless Ontario Driver, its officers, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Platform, your listings, or your violation of these Terms.

Termination

By you

You may close your account at any time by contacting us at legal@ontariodriver.ca. Outstanding commission obligations remain payable after account closure.

By Ontario Driver

Ontario Driver reserves the right to suspend or terminate your account, with or without notice, for: (a) violation of these Terms; (b) fraudulent, abusive, or illegal activity; (c) non-payment of outstanding commissions; or (d) any conduct that we determine, in our reasonable discretion, is harmful to the Platform, its users, or its reputation.

Effect of termination

Upon termination, your listings will be removed from the Platform. Sections of these Terms that by their nature should survive termination — including Sections 6 (Commission), 10 (Intellectual Property), 11 (Liability), and 13 (Disputes) — will continue to apply.

Dispute Resolution

Ontario Driver is committed to resolving disputes fairly and efficiently. The following process applies to all disputes between you and Ontario Driver:

  1. Good-faith negotiation: Either party must first provide written notice of the dispute to the other. Both parties agree to attempt to resolve the dispute through good-faith negotiation within 30 days of the notice.
  2. Mediation: If negotiation fails, either party may request non-binding mediation through a mutually agreed Ontario mediator. Mediation costs are shared equally.
  3. Small Claims Court or Arbitration: If mediation fails, disputes under $35,000 may be brought in the Ontario Small Claims Court. Larger disputes may be submitted to binding arbitration under the rules of the ADR Institute of Ontario.

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts of Ontario for any dispute not resolved through the above process.

Commission disputes must be raised in writing within 30 days of invoice issuance. Disputes raised after this period may not be eligible for review.

Changes to These Terms

Ontario Driver reserves the right to update these Terms at any time. When material changes are made, we will post the updated Terms with a revised effective date and notify registered users by email. Your continued use of the Platform following notification constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and may close your account.
